This manual is a “must have” practice guide for attorneys and advocates representing children with disabilities who have had restraint and seclusion imposed upon them; injured or damaged by such unsound techniques in the educational setting.
- Part I discusses strategies that may be used for advocating against the use of restraint and seclusion with teachers, school administrators, Individualized Education Program Teams, school resource officers, and state education departments. Chapters include information on positive behavior supports and related techniques that should be used in place of seclusion and restraint, and are founded on scientifically-based research principles.
- Part II discusses litigation strategies that can be employed to stop these techniques from being used or to compensate those injured as a result of their use. Chapters include claims under the U.S. Constitution, IDEA, Americans with Disabilities Act (ADA), Section 504 of the Rehabilitation Act, as well as several state torts.
- Part III discusses federal and state public policy initiatives.
